Terms of Service

By creating an account or using the LegalServeNow platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and LegalServeNow LLC ("Company," "we," "us," or "our"). We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

LegalServeNow is an online platform that connects clients — including attorneys, law firms, and individuals — with licensed field agents for the purpose of process serving and related legal support services. The Company acts as an intermediary and does not itself perform process serving.

Services available through the platform include:

• Standard and rush process serving
• Skip tracing
• Stakeout services
• Notarized proof of service affidavits
• Document upload, storage, and retrieval

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and that all information you provide is accurate, current, and complete.

Use of the Service for any unlawful purpose, including but not limited to harassment, fraud, or abuse of legal process, is strictly prohibited and may result in immediate account termination and referral to law enforcement.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at [email protected] if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in conduct that we determine, in our sole discretion, to be harmful to the Service or other users.

Fees for services are displayed at the time of order and are subject to change. All fees are in U.S. dollars. Payment is processed securely through our third-party payment processor (Stripe). By submitting payment, you authorize us to charge the applicable fees to your payment method.

Service fees are generally non-refundable once a field agent has been dispatched. Refund requests for services not yet initiated will be considered on a case-by-case basis. Contact us at [email protected] within 48 hours of placing an order to request a cancellation.

We make reasonable efforts to complete service of process in a timely manner; however, we do not guarantee successful service. Factors outside our control — including evasion by the subject, incorrect address information, or legal restrictions — may prevent completion.

You are responsible for providing accurate and complete address and subject information. Fees are not refunded for failed attempts resulting from inaccurate information provided by the client.

LegalServeNow is not a law firm and does not provide legal advice. Nothing on this platform constitutes legal counsel. You should consult a licensed attorney for legal guidance.

Upon successful service, a notarized Proof of Service affidavit will be provided at no additional charge. Expedited affidavit delivery (within 24 hours) is available for an additional fee. Affidavits are provided for informational purposes; you are responsible for filing them with the appropriate court or agency.

We treat all case information, documents, and personal data submitted through the platform as confidential. We will not disclose your information to third parties except as necessary to perform the requested services, comply with legal obligations, or as described in our Privacy Policy.

All content, trademarks, logos, and software associated with the Service are the property of LegalServeNow LLC or its licensors. You may not reproduce, distribute, or create derivative works without our prior written consent.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LEGALSERVENOW LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless LegalServeNow LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any third-party rights.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration in Delaware, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
